1. Introduction & Agreement
By creating an account or using WebPixie, you agree to these Terms of Service. WebPixie provides domain-based monitoring, uptime checks, security analysis, and related services. Use of the Service is limited to individuals or entities capable of entering into binding agreements.
2. Definitions
Service: WebPixie platform and related tools.
Workspace: A logical container owned by a Workspace Owner.
Workspace Owner: Primary responsible party for billing, users, and content.
Workspace Manager: Manages workspace settings, sites, and uptime checks.
Workspace User: Access-limited user.
API User: Programmatic access using permissions inherited from the creating user.
Subscription: Monthly or yearly paid plan.
Third-Party Services: External providers WebPixie integrates with.
3. Service Scope
- • Domain-based site analysis and uptime checks
- • Automated uptime monitoring (HTTP/TCP/DNS/SSL)
- • Browser (crawler) and link graph analysis: Links on the target site and content of these internal pages
- • Performance, metadata, and preview analysis
- • Slack/email notifications
- • Public status pages
- • API services for programmatic access
- • Beta, preview, or experimental features are provided "AS IS". These features may be unstable, cause data loss, or be removed at any time without notice. No warranty or SLA applies to beta features.
4. Workspace & Account Responsibilities
- • The Workspace Owner is fully responsible for all activity and billing
- • Users can add publicly accessible domain names and uptime targets; however, users are responsible for ensuring that their use of the Service complies with applicable laws and only accesses public information
- • For authenticated actions, the user must provide these credentials. The user is responsible for any liability arising from the provided credentials.
- • Penetration-style actions require domain/site ownership verification
- • API Users inherit permissions from the creating user
- • Users must protect account login credentials and API user information. Account sharing is prohibited
- • The user agrees to use the Service only for lawful purposes and acknowledges that the responsibility for decisions based on the analysis, status information, and technical outputs provided by WebPixie lies with the user.
5. Acceptable Use Policy (AUP)
Permitted:
Scanning public data, uptime monitoring, domain configuration checks, crawler-based discovery.
Prohibited:
Intrusive scans, exploitation attempts, brute force, DDoS-like behavior, phishing, fraud, spam, botnets, API abuse, security bypass attempts.
WebPixie may automatically limit traffic levels, API calls, and crawler load to protect platform security and service stability. Rate limiting, IP blocking, or temporary suspension may be applied if excessive resource consumption, API abuse, or unusual behavior is detected.
Abuse sanctions:
Warning → suspension → termination.
6. Billing & Subscription Terms
- • Credit card payments are processed securely by Stripe. WebPixie does not store card information
- • Subscriptions: free or paid subscriptions renewing monthly or annually
- • Subscription payments use USD currency
- • Taxes excluded
- • Price changes are announced 14 days in advance
- • Invoices are issued after successful payment
- • Billing disputes must be communicated within 15 days
- • Automatic payment retries on the 1st day after first failure, 3rd day, and 7th day
- • Payment failure: 7 days → suspension; 30 days → termination
- • Refund-Cancellation terms as specified in the Refund and Cancellation Policy apply
- • Upgrade: immediate; Downgrade: immediate
- • Promotions may be changed at any time without prior notice
7. Data Processing and Privacy
- • EU-priority data architecture: primary data stored in EU
- • Operational metadata may be processed globally
- • Log retention: access logs 1 year, error logs 6 months; workspace data based on subscription plan
- • Sensitive data not stored
- • Data deletion: 30 days after account termination
- • Sub-processors: AWS, Cloudflare, SendGrid, Stripe, Sentry
8. Third-Party Services & Integrations
- • Integrations include Slack, email delivery via SendGrid, and others added over time
- • WebPixie is not responsible for third-party service outages or user configuration errors
9. Intellectual Property
- • WebPixie retains all rights to its platform, content, software, and branding
- • Users receive a limited, non-transferable, non-exclusive license to access the Service
- • Reverse engineering, copying, or reselling the Service is prohibited
10. Service Changes
- • WebPixie may change, suspend, or discontinue features at any time
- • Features and services in trial may be unstable and change without notice
11. SLA & Service Availability
- • SLA terms apply only where explicitly stated in a Subscription plan
- • WebPixie does not guarantee uninterrupted service outside SLA coverage
- • Planned maintenance is performed at WebPixie's discretion with minimal disruption
12. Disclaimer of Warranties
The Service is provided "AS IS" without any warranties. WebPixie does not warrant the accuracy, completeness, or reliability of any analysis, monitoring result, status information, DNS/SSL/WHOIS data, uptime report, crawler output, or security insight. Results may be delayed, incomplete, or affected by third-party sources.
WebPixie does not guarantee error-free operation, uninterrupted service, or suitability for a particular purpose.
13. Limitation of Liability
WebPixie does not guarantee the continuity of service outputs, including data loss, corruption, delays, or interruptions due to third-party infrastructure. The user acknowledges that no commitment is made that results obtained through the service will be accurate, complete, uninterrupted, or error-free.
Total liability is limited to the total fees paid by the user to WebPixie in the last 12 months. WebPixie is not liable for indirect, incidental, special, punitive, or consequential damages; loss of revenue, profit, data, or business.
14. Indemnification
Users agree to indemnify and hold WebPixie harmless from claims arising from misuse, illegal activities, or third-party rights violations.
15. Confidentiality
Both parties agree to keep all non-public information confidential. WebPixie does not disclose customer data except to authorized sub-processors as necessary to operate the Service. Customers agree not to disclose WebPixie's proprietary or non-public information, including platform internals, unlisted pricing details, or documentation marked as confidential.
16. User Content & Feedback
Users retain ownership of all content provided, including domain names, workspace data, incident descriptions, and status page text. By using the Service, the user grants WebPixie a non-exclusive, worldwide, royalty-free license to store, reproduce, and display such content solely for operating and improving the Service. Feedback, feature suggestions, or ideas sent to WebPixie may be used without restriction.
17. Security Responsibilities
- • WebPixie applies reasonable technical and organizational measures to protect customer data
- • Users are responsible for protecting account credentials and API users
- • Users must promptly notify WebPixie in case of unauthorized access or compromised accounts
18. Termination
- • For cause: illegal activity, abuse, suspected/breach of law/terms → immediate termination
- • For non-payment: 7 days → suspension; 30 days → termination
- • User cancellation: at any time, effective in the next billing period
19. Governing Law & Dispute Resolution
This Agreement is governed by and construed in accordance with the laws of England and Wales. Disputes will be resolved by the competent courts in London. Consumers retain mandatory rights in their country of residence.
20. Changes to Terms
WebPixie may update these Terms. Continued use after changes constitutes acceptance.

22. General Provisions
Severability:
If any provision of these Terms is found invalid, the remaining provisions remain in full force.
Assignment:
WebPixie may assign this Agreement. Users may not assign or transfer rights without written permission.
No Waiver:
Failure to enforce any term does not constitute a waiver.
Relationship of Parties:
Parties are independent contractors. Nothing creates partnership, joint venture, or agency.
Force Majeure:
WebPixie is not liable for delays or failures caused by events outside reasonable control, including natural disasters, war, infrastructure failures, or internet outages.
